Uptown Flooring - Terms & Conditions
This contract is entered into between Uptown Flooring and the ‘Client’ listed in the billing section of this estimate.
1. Nature of Estimate
Unless otherwise noted in the scope of work, this estimate is a firm-fixed bid project. Once approved and signed in Jobber, client agrees to these terms.
2. Excess Materials
Any leftover material at the end of the project is the property of Uptown Flooring. There will be no credits or returns for surplus material. Uptown Flooring will leave a stain can with the mixture used for repairs, as well as extra LVP for repairs.
3. Power Requirement (Refinishing Only)
For refinishing projects, Client must provide access to 220-volt power at the job site.
4. Payments
Client agrees to make progress payments on account upon receipt of invoices as work progresses. In the event of non-payment of any sums due Uptown Flooring as herein provided for and in Change Orders, if any relating to the project herein described, Customer agrees to pay interest on such sums from the date due as above described until paid to Uptown Flooring, including but not limited to, reasonable attorney’s fees whether or not suit is brought to affect such collection.
5. Plumbing Appliances
Uptown Flooring is not responsible for any leaks from dishwashers, refrigerators, or toilets that are removed and reinstalled as part of the work. Uptown Flooring is not a licensed Plumber.
6. Furniture Moving
Client is responsible for moving all furniture unless otherwise stated in the estimate. If moving furniture is included in the estimate:
• Client must move all items under 45 pounds.
• Client must move valuables, electronics, antiques, breakables, pool tables, and grandfather clocks.
• Closets must be cleared 3 feet up from the floor if flooring is being installed or sanded.
• Uptown Flooring does not move exercise equipment or disassemble/reassemble any furniture.
7. Scope of Work
This contract excludes any work not specifically listed in this estimate or in any other signed orders; and this contract specifically excludes all paint touch up work of any kind, unless specifically included in the scope of work provided above. There will be some paint touch up needed by the Client on baseboards afterwards. We try our best to keep these to a minimum.
8. Change Orders
Any change requested by Client that affects the cost will require a written change order, signed before work begins.
9. Hidden Jobsite Conditions
Uptown Flooring is not responsible for unforeseen or hidden jobsite conditions that negatively impact the project.
10. Humidity Maintenance
Client must maintain indoor humidity between 35%-55%. Failure to do so may void the warranty.
11. Color Selection (For Stain/Sanding Projects)
Color samples will be provided upon request. Once the Client selects a color, it is final.
If Client is unhappy with the final result, a re-sand and color change will be at Client’s expense and will be scheduled at the next available opening.
12. Special Orders
Special order or modified items cannot be returned or canceled.
13. Warranty
Uptown Flooring offers a 1-year workmanship warranty on installations where Uptown supplies the material.
• Warranty excludes normal wear and tear and water damage.
• No warranty is provided on client-supplied materials.
• Seams are not guaranteed to be invisible but will be installed in a professional and workmanlike manner.
14. Final Payment & Legal Terms
Final payment is due upon completion, unless otherwise agreed. Past due amounts are subject to a 10% monthly finance charge. Legal disputes will be handled in Adams or Denver County. If legal action is required to collect payment, the Client agrees to pay Uptown Flooring’s legal and collection costs.
